You use our Services and visit any property we show you at your own risk. You are solely responsible for any damage to your property or loss of data resulting from your use of our Services, and for any injury or loss you sustain while visiting our properties.
2.3 Not Professional Advice
Home Again does not provide legal, tax, or other professional advice. You should consult appropriate professionals for advice specific to your situation.
2.4 Limitation of Liability
To the fullest extent permitted by law, Home Again and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of our Services.
3. Indemnification
You agree to indemnify and hold harmless Home Again, its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including attorneys’ fees) arising out of your use of our Services or your violation of these Terms.
4. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State in which the property at issue is located, without regard to its conflict of laws principles.
Arbitration: Except for small claims actions or where prohibited by law, any dispute between you and Home Again will be resolved through binding individual arbitration under the rules of the American Arbitration Association (www.adr.org). You and Home Again waive the right to a jury trial or to participate in class actions.
You may opt out of arbitration within 30 days of accepting these Terms by emailing arbitration-opt-out@homeagainhousebuyers.com with your name, address, email, and a statement that you opt out of arbitration.
5. Service-Specific Terms
5.1 Offers
Any “Offer” provided by Home Again to purchase your home is not an appraisal. It is simply the price we are willing to pay, subject to additional terms, conditions, and inspections. We are not acting as your agent or broker. You are free to accept or reject any offer and should independently evaluate whether to proceed.
5.2 Visiting Properties
When you access a property through Home Again:
- You confirm you are there to evaluate it for purchase or engage in authorized business.
- You must comply with all posted rules and laws.
- You accept responsibility for any damage or injury you cause.
- No smoking, illegal substances, or weapons are allowed on the premises.
5.3 Buying a Home from Us
All homes sold by Home Again are conveyed “as-is, with all faults.” We strongly recommend you obtain a professional inspection. You assume the risk of any defects not revealed by such inspections.
5.4 Brokerage and Referrals
Home Again may refer you to third-party real estate agents or service providers. We may receive referral fees for such introductions but we do not require you to work with any specific provider.
6. Notices and Contact
By providing your phone number or email address, you consent to receive communications from us, including text messages and calls using automated technology. Standard message and data rates may apply. You can opt out by following the instructions in our messages.

7. Miscellaneous
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver of our right to do so later. We may assign these Terms at our discretion; you may not assign them without our prior written consent.
